Definitions
In these Terms and Conditions: 'Us' means PixBytes.
‘You’ means the client purchasing goods or services from PixBytes.
Research Services
We aim to provide an accurate research service which is based on facts,
using the most comprehensive sources available at the time of commission, in
a professional and timely manner. There is no guarantee that PixBytes (or
any other researcher), will be able to find specific or positive results.
This may be due to, but not limited to, time allotted, common surnames,
illegitimacy, adoption, immigration, mistranscriptions, incomplete indexes,
missing, damaged or faded documents. However, we promise to do our best.
Our fees cover research, reporting and analysis time and not the
outcome of the effort. By placing a request for our research services you
acknowledge this fact and agree that no refunds will be issued due to lack
of positive results.
As research work involves using historical records which may have been
incorrectly completed, mislaid, misspelt or contain omissions, it is
possible that the occasional inaccuracy may occur. Whilst we make every
effort to verify the findings of our research, we cannot guarantee the
accuracy of the findings where evidence is unreliable or contradictory,
although we will point out anything which we believe could be doubtful.
Information provided by the client is not checked for accuracy and
therefore we cannot be held responsible for errors or omissions that
originate from this information. If you are uncertain about any areas of
your recent family history, please make us aware at the initial consultation
stage. If inaccuracies are discovered and found to be the result of
misinformation provided by the client, we are happy to arrange for
reprinting of any documents for an additional fee.
Sometimes a family line cannot be traced due to missing records,
illegitimacy, adoption, migration etc in which case clients paying for
research by the hour have the option to discontinue research at any time.
For fixed-priced research packages, if it proves impossible to make progress
with your research due to missing records, illegitimacy, etc, then you will
either be offered a pro-rata refund for the work outstanding, or be offered
research on another line of your tree to equal value.
If you cancel your research request before completion, the cancellation
will take effect immediately. We will send you a summary of the research
done to the cancellation date. Time and expenses will then be deducted from
amount paid and any refund due will be issued via the same payment method as
was received.
If you believe you have spotted a mistake in our research findings within
14 days of the results being received, please contact us. We may, at our
discretion, verify your findings and update the family tree documents. As
new documents and sources are being made available all the time, if
additional research carried out by the customer, or any other party after
this time, and finds the original research is incorrect, we cannot be held
responsible for those errors or omissions.
Copyright on Copies of Documents
Copies of documents made by PixBytes on behalf of a client are subject to
the copyrights of their respective owners. You agree to take full
responsibility for abiding by those copyrights. For example, if a client wishes,
to publish images of such documents either on the web or in print,
then it is the client’s responsibility to obtain permission from the
respective copyright owner.
Gloucestershire Archives require all Researchers acting on behalf of a
third party, to obtain the signature of that person with regard to copyright
of documents supplied. Please download their
copyright declaration
form, fill in
your name, then sign and scan the document back to us.
We will complete the necessary document references on your behalf.
Returns policy on Custom Printed Trees
The client will receive via email, a watermarked PDF copy of the tree to
view before it is printed. This is your opportunity to make any adjustments
required before the tree is printed. Once printed, custom made trees are
non-returnable.
Use of the Services
We reserve the right to refuse to print photos, images, that we learn may be
illegal, objectionable, or may violate the rights of any third party. You
confirm that we shall not be liable to you or to any third party as the
result of any such refusal.
Copyright of Photographs
Copyright laws prevent people from reproducing images and photographs unless
they own the copyright or are authorised by the copyright owner, usually the
person who created the image or took the photograph. Photographs taken by
the client or their friends and family will not usually infringe any
copyrights. Any professionally-taken photograph is subject to the
photographer's copyright and can only be reproduced with their permission
for which they often require a fee. This copyright generally expires 75
years after the death of the photographer. Illegal reproduction may result
in legal action by the photographer. We cannot copy or reproduce any images
that are protected by copyright laws.
You agree to only send us images and photos to which you own the copyright
or for which you have obtained the copyright owner’s permission. By
submitting images or photographs to us for reproduction you affirm that no
copyright will be infringed. For the avoidance of doubt, you are responsible
for keeping back-up copies of any of your images.
You grant all necessary rights, permissions and consents so as to enable
PixBytes to provide these services without restriction or obligation other
than as set out in these terms and conditions.
The finished tree produced by PixBytes is also copyright and may not be
reproduced in any way. Further copies may be ordered from us - if there are
no alterations and we still hold the file, then we will supply copies for a
reduced cost.
Acceptance of Orders
You understand that we will proceed with the order from the time your
payment arrives; we will not be liable for any delay in delivery or
non-delivery. Payment will be taken from you before your purchase is
dispatched or service is provided.
We reserve the right not to accept requests for research and in this case
your payment will be refunded in full.
Delivery Times
We will endeavour, but we are under no obligation, to dispatch your order
within the time indicated on the website. All time periods refer to working
days and do not include weekends or UK Bank holidays. We accept no liability
for loss or damage suffered due to late or non-delivery, whether this is
caused by us or by a third party.
We will deliver to the address you notify to us when you place your
order. If recorded delivery items are returned to us due to non-collection
by the addressee, or where an incorrect address has been given to us and
returned to us, we will not resend until further postage is made by the
client. If no further payment is made, then we reserve the right to dispose
of returned items.
Returns and Refunds
If an item is received in a damaged condition, you must inform us
immediately and keep all packaging until we raise a dispute with the
carrier. If an item is signed for, you must make a note on the delivery
sheet that the item was damaged on arrival; failure to do so will mean we
will not be able to provide a free replacement.
Price Information
All prices displayed on the website are correct at the time when they are
posted and prices displayed will be those charged at time of ordering. We
reserve the right to alter prices or postage charges without prior notice.
Print Quality
You hereby acknowledge that you understand that the quality of any images we
reproduce is dependent upon the quality of the original image or digital
file.
Disclaimers
We accept no responsibility or liability for the deletion or failure to
store any messages, communications or images you send to us via email or
this website. For the avoidance of doubt, you are responsible for keeping
back-up copies of all the information you send to us, and in turn, the
information we send to you.
It is your responsibility to ensure that email from us is not blocked by
your provider. We cannot be held responsible for our email not being
received by you. Usually this means that you should add our email address to
your contacts or address book.
Intellectual property
All images, product and service names, titles and copyrights, and any other
intellectual property rights used in this site are the property of PixBytes.
Any redistribution or reproduction of part or all of the contents in any
form is prohibited other than the following:
You may print or download to a local hard disk, extracts for your personal
and non-commercial use only,
You may copy the content to individual third parties for their personal use,
but only if you acknowledge the website as the source of the material,
You may not, except with our express written permission, distribute or
commercially exploit the content, nor may you transmit it or store it on
another website or other form of electronic retrieval system.
Use of third party websites and web links
Your correspondence or participation in promotions, or business dealings
with advertisers or links found on or through our website, including payment
and delivery of related goods or services, and any other terms, conditions,
warranties or representations associated with such dealings, are solely
between you and such third party. You agree that we shall not be responsible
or liable for any loss or damage of any sort incurred as the result of any
such dealings, or as the result of the presence of such advertisers or links
on or through this website.
Governing Law
These Terms and Conditions are governed by English Law. You hereby
irrevocably submit to the exclusive jurisdiction of the English Courts.
